Terms and Conditions

These Terms govern your use of the FishCastPro website, mobile and installed applications, and related services. By creating an account or using the Service, you agree to them.

Accounts and eligibility

You must be legally able to enter this agreement, or use FishCastPro with the consent and supervision of a parent or guardian. You are responsible for your account, login details, and information submitted through it.

Service scope and automated features

FishCastPro may provide catch logging and auto-save, photo-based fish identification and measurement, weather and tide information, maps, fishing recommendations, exploration suggestions, analytics, group sharing, and the Finn AI assistant.

Automated results are estimates. Fish identification, measurements, forecasts, recommended species, bait, methods, times, and locations may be incomplete or wrong. A suggested New Spot is an unverified planning candidate—not a confirmed fishing mark, access point, safe anchorage, or navigable route.

Safety, maps, and third-party data

The Service is not a navigation or emergency tool. Weather, tides, depth, bathymetry, shoreline, access, and map layers may be delayed, approximate, unavailable, or unsuitable for local navigation.

Always check official forecasts, warnings, nautical or local charts, access rights, regulations, and real-world conditions. You remain responsible for deciding whether, when, and where to fish and for the safety of yourself, passengers, vessels, and equipment.

Plans, limits, and billing

Some features require an eligible paid plan and may have daily, storage, usage, or provider limits. Features and limits can change as the Service develops. Paid subscriptions renew until cancelled and are billed under the terms shown at purchase. Refunds and cancellation rights are subject to applicable law and the billing provider's rules.

Your content and privacy

You retain ownership of catches, photos, locations, notes, feedback, and other content you submit. You grant FishCastPro the limited rights needed to host, process, analyse, back up, and present that content to operate, secure, support, and improve the Service. Content is private unless you choose to share it. Location and catch information may be used to personalise recommendations and avoid repeating suggestions you reject or report as unsuccessful.

Acceptable use

• Do not use the Service unlawfully, fraudulently, or to endanger another person.
• Do not attack, disrupt, scrape, bypass limits, or misuse accounts, APIs, maps, or shared data.
• Do not upload content you lack permission to use or violate another person's privacy or rights.
• Do not copy, resell, reverse engineer, or create derivative services from protected FishCastPro software except where law expressly permits it.

Availability and liability

We do not promise uninterrupted availability or that data will always be retained, current, or error-free. To the maximum extent permitted by law, FishCastPro is not responsible for losses caused by reliance on automated recommendations, forecasts, maps, third-party data, shared content, connectivity failures, or outdoor and boating decisions. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

Changes, suspension, and law

We may update the Service or these Terms and will provide notice where required. We may restrict or terminate accounts used in breach of these Terms. These Terms are governed by New Zealand law, subject to any mandatory consumer protections that apply where you live.
